ADOPTION FACILITATION CONTRACT

Heartfelt Adoption (herein after referred to as Heartfelt) and Adoptive parents, also referred to as Clients, agree to enter into and be mutually bound by the following terms and agreements:

  1.     ADOPTION FACILITATION: Loretta Cooper d.b.a. Heartfelt Adoption is engaged in the profession of adoption facilitation as defined by the State of California, Family Code Section 8623. Heartfelt does not place children for adoption and is not a licensed adoption agency. We may, however, advertise for the purpose of soliciting parties to an adoption or locating children for adoption. Heartfelt Adoption facilitation services are defines as follows: education, support, resources, advertising and networking as well as assisting adoptive parents if they are in need of preparing their birth mother letter/profile.

    Once a mutual commitment is reached between the adoptive couple and the birth mother it is the responsibility of the adoption agency and/or adoption attorney, or other parties, in addition to Heartfelt to develop and manage the adoption plan.   Heartfelt does not professionally counsel in order to change behavior of any birthmother,  give legal advice, manage monetary support to birth mother, or in general complete the adoption process.   Heartfelt is not contractually or otherwise obligated to participate in the creation, implementation or management of any adoption plan, nor in the legal or the social-work aspect of any adoption.  However, if Heartfelt has a concern with the unfolding of any adoption plan/development or management that are not being properly addressed by the existing professionals, Heartfelt reserves the right to intervene and assist with matters determined to be necessary and appropriate by Heartfelt, with no additional fees requested.

    Therefore, Clients have been informed, acknowledge and fully understand that Heartfelt Adoption is a facilitation service. That Heartfelt has not presented itself to be a private or public licensed adoption agency, licensed psychotherapist or counselor, attorney, law firm, adoption service provider (ASP), investigator, doctor, nor a social worker. Heartfelt does not place children for adoption. The birth mother or licensed agency places children for adoption.

  2.     ADDITIONAL POTENTIAL FEES NOT INCLUDED IN HEARTFELT FEE: Additional fees may or may not include attorneys fees, agency fees, support for the birth mother during pregnancy, medical costs, an Adoption Service Provider (depending upon your State), and possibly counseling fees. Many of the above mentioned fees will be determined by the State which has jurisdictional rights governing the adoption and whether or not it is an agency adoption or an open/independent Adoption. Clients understand that some of the birth mothers are contacting Heartfelt Adoption directly and others are provided and managed by other adoption professionals who charge fees for services rendered in connection with that adoption situation. Clients understand that in order to pursue any adoption situation provided by and/or managed by any adoption professional, they must also retain the services of that adoption professional.

  3.     STATE TO STATE ADOPTIONS: Clients also understand that adoption laws may differ with each State. Therefore, Heartfelt strongly suggests that the advice of a competent, ethical adoption attorney and/or the services of a licensed public or private adoption agency in your state be retained. This will assure that all jurisdictional State compliances will be adequately met and that the child located by Heartfelt Adoption can legally be adopted and transported across State boundaries with complete confidence that the adoption laws governing each State are adequately met.

  4.     HEARTFELT ADOPTION FACILITATION FEES: Heartfelt will be paid a non refundable fee of Forty-eight Hundred Dollars  ($4,800) for a commitment to render adoption facilitation services involving education, support, resources, advertising, and networking in connection with the routine domestic or international adoption of one child or sibling group within a period of eighteen consecutive months; said time period shall commence with the signing of this contract and continue for a total of eighteen consecutive months or one completed adoption, whichever shall occur first.

  5.     CONTRACT CANCELLATION: Clients have the right to revoke and cancel this contract for a period of 72 hours after the initial signing and dating of this agreement. Within that time, Clients may request a refund of their fees paid to Heartfelt, without penalty, with the exception of a minimal fee deemed earned at the initial interview in the amount of Seven Hundred Fifty Dollars ($750.00). Otherwise, this Contractual agreement is not contingent and no portion of the Forty-eight Hundred Dollar fee ($4,800) is refundable.

  6.     This Contract may not be transferred or sold.

  7.     CONTACT: Heartfelt encourages contact by the Clients at anytime and as often as they wish. Clients are encouraged to keep Heartfelt and all professionals involved in their adoption informed at all times of their changes in address and/or telephone numbers and general whereabouts. Clients are also responsible for forwarding additional copies of their birth mother letters/profiles to the managing adoption professionals or birth mothers for consideration.

  8.     WARRANTIES: Heartfelt does not guarantee that the birth parents or the adoptive parents will complete the adoption process. Heartfelt does not conduct independent investigations to substantiate any assertions made by the birth parents; therefore, cannot guarantee the validity of the information given by any birth parents. Heartfelt is not responsible for the birth parents concealment of information. Heartfelt Adoption cannot guarantee that all birth mothers will seek and receive prenatal care or be drug free during the course of her pregnancy. Heartfelt does not guarantee that a particular couple will be chosen by a particular birth mother. Furthermore, Heartfelt cannot guarantee that the circumstances surrounding any adoption plan will remain the same during the course of the adoption plan.

  9.     INFORMATION AND PHOTOGRAPH RELEASE: Clients give permission for Heartfelt to show their birth mother letters to prospective birth parents and other professionals working on our behalf in order to connect clients with a birth mother who wishes to relinquish her baby. Clients give Heartfelt permission to display photos of the baby and family sent to Heartfelt by the clients themselves or taken by Heartfelt. By the signatures below, Clients agree to allow Heartfelt to freely discuss all aspects of their adoption with all the professionals involved in the adoption procedures.

  10.    ADOPTION INSURANCE: Clients may consider the purchase of adoption insurance.

  11.    NO GUARANTEE. Heartfelt makes no representation as to whether or not potential adoption situations will be available to present to the clients in any given time frame, that clients will be considered or selected by a birth mother, nor that any proposed domestic or international adoption plan entered into will be successfully completed. Furthermore, Heartfelt cannot guarantee the physical, emotional, mental condition, or any condition of any child or children involved in any adoption.

  12.    BINDING ARBITRATION IN CASE OF A DISPUTE:  This facilitation contract is prepared in accordance with the laws of the State of California.  Therefore, parties agree if a dispute arises out of the performance of services rendered and/or fees under this contract, that the matter will be submitted to binding arbitration.  The parties also agree to the mutual selection of an arbitrator and if agreement cannot be reached it will be submitted to the American Arbitration Association and the dispute will be arbitrated in accordance with the rules of the American Arbitration Association.  By  their signatures below, clients agree to settle all disputes through binding arbitration located in the venue of Sacramento County, Sacramento, California.
